INTRODUCTION


This document contains the terms and conditions for access and use of the website www.yrlegal.com (the “Website”). Please read these terms of use (“Terms of Use”) carefully before you start using the Website.

By accessing and using the Website, you give your consent to observe and to be bound by these Terms of Use and by any subsequent supplements and amendments thereto and you re-affirm this consent every time you access the Website. If you do not accept these Terms of Use, please do not use the Website and leave it immediately.

The Website is registered to the name of and is operated and maintained by Yordanova, Rizova & Partners Law Office, registered in the list of law firms under company case № 8686/2006 of Sofia City Court, company division, with registered seat and management address at 3, Shipka Sr., fl.3, Oborishte municipal region, Sofia, BULSTAT 175119603 (hereinafter referred to as “YRP” or “We”).

2. WEBSITE ACCEPTABLE USE POLICY

You may use the Website in accordance with the applicable law, these Terms of Use and other documents, applicable to the services, offered on the Website, if any. You may not use the Website:
(i) in any way that breaches any applicable local, national or international law or regulation;
(ii) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
(iii) for the purpose or with the result of harming or attempting to harm YRP, other Website users or any third party;
(iv) to knowingly introduce/ transmit viruses, Trojan horses, worms, time-bombs, spyware, denial-of-service attacks, keystroke loggers, adware, IP spoofing and any other harmful programs or malwares;
(v) to transmit/ introduce materials which are illegal, threatening, untrue, misleading, fraudulent, obscene, offensive, slanderous, insulting, disgraceful, pornographic, uncensored or materials which incite to violence or other illegal or immoral actions or which infringe the good name and the reputation of YRP or the honor and dignity of third parties or which infringe copyright and neighboring rights, rights to trademarks and other intellectual property rights;

You also agree that you:

(i) shall not reproduce, duplicate, copy or re-sell any part of the Website or its content in breach of the law or these Terms of Use and shall not create derivative works from it;
(ii) shall not make unauthorized access to the Website and shall not interfere with, damage or disrupt:
   - any part of the Website or its content;
   - servers, equipment or network on which the Website is stored;
   - databases, connected to the Website;
   - the services and materials, available on the Website;
   - any software used for the operation/protection of the Website; or
   - equipment, network or software owned or used by any third party.
(iii) shall not take actions to deactivate, damage or interfere with the measures, used by YRP or third party to protect the Website, as well as the servers, systems or any other equipment related thereto;
(iv) shall not use any technical devices, scripts, programming language, software or other methods to interfere with the normal operation of the Website or the activity of other Website users and shall not make attempts to decipher, de-compile, disassemble or reverse engineer any of the software comprising or representing a section or module of the Website;
(v) shall not retrieve information from the Website, using bots, spiders, crawlers or any other manual or technical devices.

3. INTELLECTUAL PROPERTY

The Website and its content, including but not limited to trademarks, logos, brands, text, design, structure, functionalities, software, including back-end code, images, photographs, pictures, illustrations, graphics and sound, belong to and are property of YRP or its partners and are subject to copyright and other protective laws.

You shall not change, alter or delete any trademark, copyright or other notices on the Website or on the paper or digital copies of any materials you have printed off or downloaded.

You may use, download or print materials available the Website for your own personal and non-commercial use only. You may forward such materials to third parties for their personal and non-commercial use only provided that you acknowledge the Website as the source of the material and inform these third parties that they must comply with the Terms of Use. No part of the Website materials may be otherwise copied, reproduced, stored, republished, uploaded, posted, transmitted, disseminated or distributed in any form or by any means, without YRP’s prior written consent. Website materials may not be distributed, copied or otherwise used for commercial use or benefit and no part of the Website may be reproduced, transmitted, stored or embedded in another website or another form of electronic retrieval system.

Access to, navigation and use of the Website is under the full responsibility,
sole discretion and risk of the user.

YRP reserves the right to withdraw or change the services, available on the Website, as well as to suspend, discontinue or restrict the access thereto without notice. We do not guarantee that the Website or any content on it will be available without interruptions or delays and we shall not be liable if for any reason the Website or any content on it is unavailable at any time or for any period.

We may change the content of the Website at any time, including by editing the whole information available on the Website.

These hyperlinks are for your convenience and your information only and do not imply any form of association or relationship between YRP and the owner of the linked website and should not be interpreted as endorsement by us of those linked websites. Your websites may link to our home page, provided that you do not damage or take advantage of our reputation and do not damage our copyrights or other intellectual property rights. Such links may not suggest any form of association, relations, approval, license or endorsement on our part where none exists.

You must not establish hyperlinks to the Website from any website that is not owned by you or from a website you are not entitled to operate or to publish on it.

You may not create a link to any part of the Website other than the home page.

6. OUR RIGHTS

Failure to comply with applicable laws and these Terms of Use and in case of any other reasonable considerations, YRP may take the following actions without a prior notice:
(i) immediate, temporary or permanent suspension of your access to the Website and the available services;
(ii) disclosure of certain actions of yours to the respective law enforcement authorities;
(iii) legal proceedings against you for reimbursement of all costs resulting from your breach.

The Website and the materials on the Website are provided on an "as is" and an "as available" basis and (to the fullest extent permitted by applicable laws) we make no and exclude all explicit or implied warranties and representations of any kind,
including without limitation (i) regarding the timeliness, accuracy, applicability, completeness, reliability, availability or fitness for any particular purpose of the Website and its contents; (ii) that the use of the Website will be error-free, secure and uninterrupted.

All materials on the Website have been prepared for general information purposes only (e.g. to permit you to learn more about YRP, its team
, services and experience ot to alert you of certain legislative changes). The information on the Website (i) does not contain a comprehensive analysis of the matters presented; (ii) is not provided in the course of and does not create or constitute an attorney-client relationship; (iii) does not convey or constitute legal advice; and (iv) is not a substitute for obtaining legal advice. YRP shall not be liable for any loss or damage incurred as a result from (i) accessing, use or inability to use the Website; or (ii) use or reliance on information available on the Website, and disclaim any liability with respect to acts or omissions made on the basis of information on the Website.

We exclude to the fullest extent permitted by applicable laws any liability for any loss or damage, caused to the software, hardware and the data of Website users or third parties by errors, failure of performance, omission, interruption, defect, computer viruses, denial-of-service attack, other malicious codes or harmful components resulting from using the Website and from downloading of materials, published on it or on a website connected to it.

8. FINAL PROVISIONS

YRP reserves its right to amend and/or supplement the current Terms of Use at any time. The changes enter in force immediately after their publishing on the Website, unless otherwise provided in the updated version of the Terms of Use. If you continue to use the Website after the changes, we consider that you have accepted the changes to the Terms of Use. You should visit this page from time to time to review the Terms of Use, since they are binding on you. YRP shall not be liable if a user has not reviewed the updated version of these Terms of Use. In case the changed Terms of Use are not acceptable for you, please discontinue using the Website.

YRP reserves the right to make subsequent changes, to modify, alter, move or delete parts of the Website or to add parts/modules/ segments thereto, as well as to activate, change or deactivate services at any time and without prior notice.

In the event that any provision of these Terms of Use is held to be invalid or unenforceable, the remainder of these Terms of Use shall remain in full force and effect.

The present Terms of Use are governed by Bulgarian law. Any disputes between YRP and the Website users arising from these Terms of Use would be resolved by negotiations and if this turns to be impossible – by the competent Bulgarian court.

II. Privacy Notice for Job Applicants  at Yordanova, Rizova & Partners Law Office

This Privacy Notice (“Privacy Notice”) describes the method by which “YORDANOVA, RIZOVA & PARTNERS” LAW OFFICE, registered in the list of law firms under company case № 8686/2006 of Sofia City Court, company division, with registered seat and management address at 3, Shipka Sr., fl.3, Oborishte municipal region, Sofia, BULSTAT 175119603 (“YRP”) as personal data controller, processes job applicants’ personal data (hereinafter referred to as “Applicants”).


1. TYPES OF PERSONAL DATA PROCESSED

YRP collects and processes personal data relating to you, including:

  • Your name, address, contact details (email, telephone number);
  • Information included in your CV, cover letter, diplomas, certificates, letters of recommendation and any other information related to your previous professional experience, length of service, education, specialty, qualifications, legal capacity, training, skills, language and other skills, tests scores, professional and personal interests, and any other information which s been voluntarily provided by you in relation to your job application;
  • Your responses to questions asked by us during interviews within the framework of the selection and recruitment processes performed by YRP.

YRP collects this data on the basis of the documents and information provided by you personally, including through interviews and various forms of assessment applied by YRP in the selection and recruitment process. YRP may also collect personal data relating to you from third parties such as previous employers, referees, recruitment agencies, etc.
The provision of your personal data is entirely voluntary. Failure to provide your personal data will prevent YRP from considering and assessing your application for employment.

2. PURPOSES OF PERSONAL DATA PROCESSING

YRP processes your personal data for the following purposes:

  • Initial selection and subsequent assessment of candidates with the necessary experience, qualifications, knowledge, skills and other qualities for the vacancy;
  • Contacting you to request further information from you, to keep you informed of the progress of the selection and selection procedures and of the final results;
  • Conducting interviews or other forms of assessment applied by YRP in the process of assessing job applicants.

If, on the basis of your application, YRP makes an offer of employment to you, which you accept, your personal data collected during the selection process will be used for the purposes of drawing up, agreeing and concluding an employment contract between you and YRP.

3. LEGAL BASIS FOR PROCESSING

YRP processes your personal data on the basis of your informed and freely given consent, which you express unambiguously by your voluntary submission of application documents to YRP on paper or electronically. The processing of your personal data is also carried out for the purpose of taking selection and selection steps at your request (implicitly in your application) prior to entering an employment contract with YRP.

4. ACCESS TO AND PROVISION OF DATA

Access to the personal data of applicants for employment at YRP shall be available to the Office Manager and the Partners of YRP, as well as Senior Associates in connection with an assessment of the professional experience, qualifications or performance of applicants, to the extent deemed necessary by a Partner.

5. PERSONAL DATA STORAGE

Applicants’ personal data shall be stored for the period of 6 (six) months, except when an applicant has agreed for a longer period.

6. DATA SECURITY

YRP maintains appropriate technical and organizational measures to protect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data.
YRP provides the necessary security level which corresponds to the risks that may arise during the processing, taking into account the state of technological progress, the costs of implementation and the nature, scope, context and purposes of the processing, as well as the risk to you. These measures are aimed at ensuring the continued integrity and confidentiality of personal data. YRP regularly evaluates these measures to ensure the security of processing.

7. YOUR RIGHTS

Your rights considering the processing of your personal data by YRP are as follows:

  • Right of access - the right to confirm whether YRP is processing your personal data and, if so, to have access to it and to certain information about that processing and a copy of the data that is being processed;
  • Right for correction of your personal data in case it is inaccurate or incomplete;
  • Right for deletion of your personal data (“right to be forgotten”)- when the data is no longer needed for the purpose of the collection or processing in another manner, or if, for instance, the data has been processed illegally;
  • The right to restriction of processing - for a period that allows us to verify your complaint, if you contest the accuracy of your personal data, and in other cases provided for by applicable law;
  • The right to data portability - the right to receive your personal data that you have provided to us and that is processed in an automated manner and on the basis of your consent or contractual obligation, in a structured, commonly used and machine-readable format, and to transfer that data to another controller without hindrance from YRP, or to request that YRP transfers your personal data directly to another controller where this is technically feasible;
  • Right to withdraw consent - you may withdraw your consent to the processing of your personal data at any time without affecting the lawfulness of processing based on consent prior to its withdrawal. If you withdraw your consent, you will frustrate YRP’s ability to consider and assess your application for employment.

8. PROFILING AND AUTOMATED PROCESSING OF PERSONAL DATA

YRP will not use your personal data for the purpose of profiling and automated decision making.
